Powys (2.5.25) - Good Afternoon, I hope this mail finds you well, we are circulating this email to inform you all as valued stakeholders of Powys Highways Strategy of Managing Risk from Trees. What started as a policy to manage Ash die back on the highway network has now developed into a strategy to manage risk from trees to highway users and follows the guidance of The National Tree Safety Group “Common sense risk management of trees” guidance. As a landowner Powys County Council is responsible for the care and management of its trees and has a legal duty of care to ensure that users and neighbours of its land are safeguarded (as far as is feasible/reasonable) from avoidable harm. As a prudent landowner the authority must be able to demonstrate that the Council has met its responsibilities and duty of care as a tree owner in a systematic and reasonable manner. As a highway authority Powys County Council has a responsibility to ensure the safety of all users in so far as reasonably practicable of the network through the monitoring and maintenance of both Council owned trees and those that are privately owned but have the potential to pose a hazard to highway traffic. Our highway network is fully surveyed for trees of risk every two years. Trees identified with hazards, are subject to a quantified risk assessment using QTRA an internationally recognised method for quantifying risk of harm to the public. Where the risk of harm to highway users is calculated to be greater than 1 in 300,000, those trees are recorded as assets. These assets are subject to their own inspection frequency, which is typically conducted annually. This systemic approach to tree inspections ensures we meet our legal obligations and comply with industry best practice. As each community council area is inspected, we will forward a short report of the findings to the elected member for the area as well as the community/town council. Many of the trees we survey are privately owned and we will be required to send legal notices to landowners (Section 154 Notice of The Highway Act), to reduce the risk from trees that legally are at a level of risk of harm to people or property that should not be imposed on others, should private landowners contact you about these notices then please signpost them to the newly created webpage on Powys County Council Public Website https://en.powys.gov.uk/HighwayTrees https://cy.powys.gov.uk/CoedPriffyrdd .
